Terms of Business

1. The presentation of property details on this website does not constitute an unqualified offer of sale. All sales agreements are documented in a written contract between the parties and all such agreements must be executed by a director of Wellington Estates Ltd. There are no Power of Attorney permissions in place.

2. Payment of a Reservation Fee, normally in the region of £2,000, will reserve the property and usually at a fixed price. The Reservation Fee can be refunded by Wellington Estates Ltd at any time, and all our obligations cease. Alternatively, if the Purchaser wishes to proceed and solicits a draft contract either to be sent to him or his lawyer, then the Reservation Fee becomes a non refundable deposit which the Vendor can retain wholly or partially at his sole discretion in the event that the sale proposal does not culminate in exchange of contracts. Also, should the Purchaser request a Mortgage/Loan and complete an Application Form in order for an assessment to be made, or engage in discussions concerning property orientation or modifications, then the Reservation Fee becomes a non refundable deposit.

3. The terms of a sale or mortgage/loan are fully documented in the relevant contract, save that any mortgage/loan is subject to overiding mortgage/ loan conditions. Prices quoted by Wellington Estates Ltd are normally on the basis that the Purchaser is liable for all taxes, including KDV, Capital Gains, Stamp Duty and Transfer Fee. Should the Purchaser or his lawyer seek an alternative distribution of this liability, then Wellington Estates Ltd reserves the right to adjust the sales price accordingly.
