Whilst similar named companies may exist and be registered in other jurisdictions, they have no relationship with the aforesaid TRNC company. These terms and conditions and your use of this website are governed exclusively by TRNC law and any disputes arising from or in connection with these terms and conditions and your use of this website shall be subject to the exclusive jurisdiction of the courts of the TRNC.

8.  Agents, Contractors and other persons
Wellington Estates Ltd has relationships with sales agents, contractors and advisers. These are independent third party persons or companies irrespective of the jurisdiction in which they were formed or the location in which they normally reside or operate. Any information provided by these persons in respect of Wellington Estates Ltd should be scrutinised and verified by a potential customer and not relied on at face value.

9.  Trading Terms
The terms under which Wellington Estates Ltd sells and constructs properties in TRNC are laid out in the Contract of Sale. These should be interpreted within the framework of TRNC law and no other, unless reference is made to laws of another jurisdiction in the contract.

Reservation fees, which are normally in the sum of 2000GBP, enable a potential customer to reserve a stated plot and property for a period of 21 days. If after this time has elapsed, there is no contract of sale in place, then this reservation becomes void. Wellington Estates Ltd has sole discretion to either retain or reimburse part or all of any reservation fee received. If Wellington Estates Ltd is requested to travel to meet with the customer or draw a property orientation plan for a specific plot, or design bespoke features and develop a modified property plan, the customer should be aware that this incurs costs. These costs will be deducted from the reservation fee if the customer does not proceed to exchange contracts without good reason.

The standard contract of sale is available for perusal from genuine prospective customers, without charge or obligation. Copies of Title Deeds, Planning Permissions and Land Searches are also available in order to demonstrate the integrity of our operations.

Liability for TRNC taxes is normally stated in any contract of sale. In the absence of clarity, or in the event of the introduction of new taxes post contract, Wellington Estates Ltd reserves the right to postpone the issue of title deeds to customers until an agreement is reached concerning the apportionment of taxes.

Wellington Estates Ltd may offer mortgages or loans to customers as part of the service it provides. The company is under no obligation whatsoever to offer this service and a decision by the company to offer or refuse this facility is final and there is no appeal procedure in place. All mortgages and or loans terms are articulated in a contractual agreement between Wellington Estates Ltd and a customer and are at all times, and without exception, subject to the Mortgage and or Loan Conditions and the contents of this latter document override all others including contracts.

10.  Dispute Resolution
From 1 October 2010, we are offering customers an opportunity to resolve any disputed issues by Mediation and Arbitration. Wellington customers have always had the right to sue the company in the TRNC, which is the jurisdiction governing the Contract of Sale and the geographical location of property activities. The Mediation and Arbitration facility is less formal and costly than traditional litigation. It can also take place outside of the jurisdiction of the TRNC courts. It can, for example, take place in the UK, if this is requested by the customer.

11. UK Data Protection Act 1998 (the Act)
Although the provisions of UK and EU legislation do not apply to Wellington Estates Ltd, the above Act sets standards to which we endeavour to adhere.

Wellington Estates Ltd takes the security and privacy of those of its clients and contacts about whom it holds personal information extremely seriously. We follow strict security procedures in the storage and disclosure of personal information given to us in order to prevent unauthorised access.

Personal Data is held on our contacts and administration database either because of work we have undertaken or are currently engaged in, or because our clients have indicated that they would be interested in receiving material from us about our business and services. To that end we hold client contact details and the history of our client relationship. This allows us to manage our client relationships effectively and target items of interest so that clients do not receive unwanted material through the post.

In accordance with the spirit of the UK Act, clients may request the amendment of the personal information held and to cease receiving direct marketing materials.

Wellington Estates Ltd does not sell, rent or otherwise deal in the personal information we hold with third parties. Information may, in the ordinary course of business, move between different persons and computers within Wellington Estates Ltd or to our agents and contractors, which involves the transfer of data outside of the UK and the EU.
